01Agreement to terms

By accessing our website (bandicootlabs.com) or using any Bandicoot Labs applications ("the Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

02About Bandicoot Labs

Bandicoot Labs is a software studio based on the Sunshine Coast, Australia. We design and build websites for Australian businesses, AI integration for growing teams, and original consumer products. Our offerings include:

• Custom websites: design, build, hosting, and ongoing care for service businesses.
• AI integration & automation: reply enhancement, translation, classification, and bespoke workflows.
• Bespoke software: internal tools, customer portals, and web apps.
• Reply Polish: AI-powered text enhancement for customer support replies.

03Eligibility

You must be at least 18 years old and have the authority to enter into these terms on behalf of your organisation. Our Services are designed for business use.

04Account and registration

To use our applications, you must:

• Have an active account on the relevant platform (where applicable).
• Install our applications through the appropriate marketplace.
• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorised access.

05Subscription and billing

Each service has its own pricing structure. Generally:

• Free plans: available with usage limitations.
• Paid plans: billed monthly via the relevant marketplace, or invoiced directly for project work.
• Billing for marketplace apps: handled by the marketplace. We do not process payments directly.
• Cancellation: may be done at any time through the marketplace, taking effect at the end of the current billing period.

06Acceptable use

You agree to use our Services only for lawful purposes and in accordance with these terms. You will not:

• Violate any applicable laws or regulations.
• Infringe on intellectual property rights.
• Attempt to reverse engineer, hack, or compromise our Services.

• Circumvent usage limits or rate limits.
• Use our Services for spam or malicious purposes.
• Resell or redistribute our Services without authorisation.

You retain all rights to your content and data processed through our Services.

09Service availability

We strive to provide reliable services but cannot guarantee 100% uptime. Our Services may be temporarily unavailable due to:

• Scheduled maintenance (we will provide notice when possible).
• Third-party service outages (Anthropic, cloud providers, etc.).
• Technical issues, security incidents, or force majeure events.

10Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our Services are provided "AS IS" without warranties of any kind, express or implied.
• We are not liable for the accuracy or quality of AI-generated content.
• You are responsible for reviewing and approving all content before sending to customers.
• We are not liable for service interruptions, data loss, or indirect damages.
• Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim.

11Indemnification

You agree to indemnify and hold harmless Bandicoot Labs from any claims, damages, or expenses arising from:

• Your use of our Services.
• Your violation of these terms.
• Your violation of any laws or third-party rights.
• Content you process through our Services.

12Changes to services and terms

We reserve the right to:

• Modify or discontinue Services with reasonable notice.
• Update these terms at any time.
• Change pricing with notice to existing subscribers.

Significant changes will be communicated via email or through the relevant marketplace. Continued use after changes constitutes acceptance of new terms.

13Termination

You may terminate your use of our Services at any time by:

• Uninstalling applications from your platform.
• Cancelling your subscription through the relevant marketplace.

We may suspend or terminate access if you:

• Violate these terms.
• Abuse or misuse our Services.
• Fail to pay subscription fees.
• Engage in fraudulent or illegal activity.

Upon termination, your right to use the Services ceases immediately. We will retain or delete data as described in our privacy policy.

14Dispute resolution

If you have a dispute with us, please first contact us at support@bandicootlabs.com to seek an informal resolution. If that fails:

• Disputes will be resolved through binding arbitration or in courts of competent jurisdiction.
• These terms are governed by the laws of Australia.
• Both parties waive the right to a jury trial.
• Both parties waive the right to participate in class actions.

15Third-party services

Our Services integrate with third-party platforms and services:

• Helpdesk platforms: where applicable to specific applications.
• Anthropic: AI processing provider.
• Cloud infrastructure: hosting and database providers.

Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services or their availability.

16Export and trade compliance

You agree to comply with all applicable export and import laws. You may not use our Services in countries subject to U.S. trade embargoes or for any prohibited end-uses.

17Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.

18Entire agreement

These Terms of Service, together with our privacy policy and any product-specific terms, constitute the entire agreement between you and Bandicoot Labs regarding our Services.

• We are not liable for any consequences of using AI-generated content.
